On your employee's start date, you’ll see a note on your Home page and an email reminding you to complete the employer portion of the Form I-9. If the I-9’s not in the employee's account, send them the Form I-9 to complete outside of Gusto.
If you need to edit the I-9, you'll have to do it outside of Gusto. Once edited, we recommend uploading the corrected version to your employee's profile so everything is up to date.

If you hire a remote employee, you must complete Form I-9 with them by their start date. Form I-9 is required by the federal government to verify an employee’s identity and eligibility to work in the United States.
Temporary pause of in-person document review for remote employees
Section 2 of the I-9 requires the employer to review identification and employment eligibility documents. Normally, the employer must review the documents in person. In light of the pandemic, employers may verify the documents remotely until July 31, 2023.
New requirement—Aug 30, 2023 deadline
If you previously examined documents remotely in light of the pandemic, you have until August 30, 2023 to complete in-person physical document inspections for employees whose documents were inspected remotely.
The new hire must complete Section 1 of the form by their start date. The employer must complete Section 2 within three business days of the start date.

A citizen is someone who was born in the United States or is a naturalized citizen living in the United States.
A lawful permanent resident is someone who is not a United States citizen and who resides under legally recognized and lawfully recorded permanent residence as an immigrant.
This includes anyone who is authorized to work in the United States but is not a United States citizen, United States national, or lawful permanent resident.
A noncitizen national is someone born in American Samoa, certain former citizens of the former Trust Territory of the Pacific Islands, and certain children of noncitizen nationals born abroad.
Once Form I-9 has been completed, you can view it in an employee’s profile. You can also download all I-9s Gusto has on file for your entire team.
