Employers must stay compliant under Department of Labor (DOL) regulations connected to employment, anti-discrimination laws, etc. They must also disclose information to participants that may impact their cost or eligibility for Medicare.
If you have benefits with Gusto, here’s what we’ll do to help keep you compliant:

Provide Medicare Part D Notices-Notice of Creditable/Non-Creditable Coverage to employees regarding their prescription drug coverage to remain compliant with CMS regulations. These are sent to Gusto-brokered groups in early October, and are available to employees in the Documents section of their Gusto accounts.
- Notices are not sent for groups using Gusto’s broker integration.

Provide the Children's Health Insurance Program Reauthorization Act of 2009 (CHIPRA) which is available in SPDs under the heading "Note Regarding Premium Assistance Under Medicaid and the Children's Health Insurance Program (CHIP).”

Help employers evaluate classes (where applicable) to avoid violation of non-discrimination rules related to class participation.
