If you have benefits with Gusto, here’s what we’ll do to help keep you compliant:
Provide Medicare Part D Notices-Notice of Creditable/Non-Creditable Coverage to Medicare-eligible individuals regarding their prescription drug coverage to remain compliant with CMS regulations, with distribution typically occurring by October 14th each year. These are distributed to Medicare-eligible individuals in Gusto-brokered groups by early October in advance of the October 15th deadline and are available to employees in the Documents section of their Gusto accounts.
Notices are not sent for groups using Gusto’s broker integration.
Help employers meet their obligation to provide the Children's Health Insurance Program Reauthorization Act of 2009 (CHIPRA) notice. This notice, which informs employees about potential opportunities for premium assistance under Medicaid and CHIP, is typically included in Summary Plan Descriptions (SPDs) under the heading "Note Regarding Premium Assistance Under Medicaid and the Children's Health Insurance Program (CHIP).”
Help employers evaluate eligibility classifications (where applicable) to avoid violation of non-discrimination rules, such as those under HIPAA, related to class participation in group health plans.
