This section is for employers with 50 or more full-time equivalent (FTE) employees.
Form 1095-C proves an employee got or was offered health insurance by their employer. Employers sometimes provide the form to both the employee and the Internal Revenue Service (IRS).
For tax filings, Form 1095-C is only required for employers that averaged 50 or more FTE employees in the previous year.

If you had Gusto-managed benefits during a tax filing year and averaged 50 or more FTE employees in the previous year, we’ll prepare the form and mail it at the end of the year. It will not be available in your Gusto account. If another broker manages your benefits, contact them directly for help with Form 1095-C.
This section is for employees who have a Health Savings Account (HSA).
Two tax forms apply if you have an HSA:
1099-SA: You receive this by January 31. It shows your annual distributions. You’ll only get this form if you made distributions from your HSA in the prior calendar year, meaning you spent HSA funds on qualified expenses.
5498-SA: You receive this by May 31. It shows your annual contributions.

This section is for employees with health coverage through Gusto.
Form 1095-B is the form most people with benefits will get from their insurance carrier. You can reference this form when verifying on tax returns that you and your dependents have at least Minimum Essential Coverage (MEC).

Your insurance carrier sends this directly to the plan’s primary subscriber. Contact your carrier to request another copy.
