A compliance checklist—requirements to consider

Consider these requirements when doing business in new states and hiring new employees.

  1. Fill out employee onboarding forms
    • New hires need to complete:
      • W-4 form: Tells you how much tax to withhold
      • I-9 form: Proves they can legally work in the U.S
    • You’ll need to check their ID (passport, driver’s license, etc.) as listed on the I-9
    • Keep these forms on file—Gusto will store them electronically for you
  2. Report new hires to the state
    • You must report new hires to the state where they work. The state uses this info to track debts (like child support).
    • This report is usually due within 20 days of hire.
    • Gusto can file a new hire report for you if you choose the option when adding an employee.
  3. Get Workers' Compensation Insurance
    • Most states require this insurance, and Gusto can help. It covers employee injuries or illnesses on the job, providing benefits to employers and employees.
    • You can get it through:
      • A commercial carrier
      • Your state’s insurance program
  4. Display required workplace posters
  5. Follow labor laws
    • Learn the employment laws that apply to your business, like:
      • Minimum wage rules
      • Wage garnishments
      • Termination policies
      • Contractor classification
    • The Department of Labor’s Employer Guide has many of those details.
    • The Small Business Administration also offers a 10-step guide for starting a business, which includes everything from writing a business plan to applying for licenses and permits.
  6. Offer health insurance (optional)
    • If you offer health insurance, follow ACA regulations.
    • If you have benefits managed by Gusto, we help keep you compliant by:
      • Handling pre-tax payroll deductions
      • Providing 1095-C forms (when required)
      • Sharing the ACA Marketplace Notice with new hires
      • Storing the Section 125 document in your account
      • Keeping you aligned with your current policies and carrier
